Interest of the Child Approach
Psychologists are saying that they must make D* fit the reality of
his situation including current divorce decrees, rather than
gathering information and having those agreements modified for his
benefit. This is
the square peg must fit the round hold approach to psychology. It is
appropriately used on soldiers and other people who have a duty they
can not avoid. Living with one's mother is not such a duty.
The approprate approach for child is the 'best
interest' model of psychology. According to this model the child is listened
to, his situation is evaluated and changes are made to the
environment in the child's best interest while respecting parental
relationships. This is the law in Texas, and the law according to
the UN Convention on the Rights of a Child, which is part of the
Human rights framework. It is also common sense. Children are not
soldiers who must bend to the decisions of the court, rather the
court must bend to accommodate the children. A family court room is
not a criminal court room where there is a choice to find mom or dad guilty, rather instead
it is a facilitator of a solution for the child.
