Tom,

It is clear that we do not have mutual agreement on summer schedule.

Per our divorce decree, section (b), "Mutual agreement or Specified Terms for Possession" in page 9,

IT IS ORDERED that the conservators shall have possession of the child at times mutually agreed to in advance by the parties, and, in the absence of mutual agreement, it is ORDERED that the conservators shall have possession of the child under the specified terms set out in this Standard Possession Order.

Your proposed period, from Aug 1 til Aug 14 with written notice by April 1 does not follow our agreement on section (c), item (7) on page 10, which says, THOMAS WLAKER LYNCH shall have possesion of the child for two full weeks beginning no earlier than the day after the child's school is dismissed for the summer vacation and ending no later than seven days (2005-2006 school starts August 16) before school resumes at the end of the summer vacation in that year, to be excercised in no more than two separate periods of at least seven consecutive days each, as specified in the written notice. These periods of possession shall begin and end at 6:00 p.m.

Per our divorce decree, section (c) "Parents Who Reside 100 Miles or Less Apart", item (7) "Extended Summer Possessions by THOMAS WALKER LYNCH", on page 10, without written notice by April 1, THOMAS WALKER LYNCH shall have possessio of the child for fourteen consecutive days in that year beginning at 6:00 p.m. on July 1 and ending at 6:00 p.m. on July 14.

Therefore, following the court order, you shall have possession of the child for fourteen consecutive days
in that year beginning at 6:00 p.m. on July 1 and ending at 6:00 p.m.
on July 14.

This makes for the third schedules change proposed. None of them have
been reasonable, or consistent with my notice.

You had the right idea when you left D* with me when you went to
England. Not only because I wanted to spend more time with him as you
said, but also because a) D* wanted it, and b) because it is good
for our son to spend time with his father. You made a small step in
the right direction with this decision, and it has been long in
coming. Please don't start back peddling now.

D* has a long enough summer break for both of us to spend our
time off with him. Also, D* and I have spent six weeks together
or more in all prior summers. All. It will be good for D* to do
the same this year. He expects it. We have plans and a lot of stuff
to do. Let us use our mutual advantages in Dimitri's best interests.
Why not discuss the topic from this point of view, rather blithely
citing pages and paragraphs?
