Call Regarding D*'s Medical Records Including Lactose Intolerance

Becky S: Pediatrics this is Becky may I help you?
Tom Lynch: Hello Becky my name is Tom Lynch, D* Lynch's father. i was calling to find out if you guys were aware that he is dairy intolerant. Last summer we went through a great deal of effort to establish that. I took him up to the Mayo clinic in Rochester Minnesota and he took a special test. They have a gas chromatograph test for it now.
Becky S: Yes, I found that chart but it doesn't saying anything about recommendations for taking any kind of enzyme.
Tom Lynch: Excuse me? Your saying that...
Becky S: According to Dr. Miroff. My recommendations are as follows, Lactose malabsorbtion, Plan is for him to go on a lactose limited diet and to return to Mayo as needed. But it doesn't say anything about enzymes. And that is October 18 and there is another update on October 30th. D* returned for follow-up of lactose malabsorbtion, did do a complete evaluation for diarrhea and that was negative.
Tom Lynch: Well you know whats funny, is that the nurse form the Mayo clinic gave us a letter to the school recommending that D* take enzymes. What they are saying is that the test is positive so why wouldn't he take enzymes? Its sort of like saying the patient has x. Are you saying we shouldn't take enzymes?
Becky S: Well I'm saying that the doctor didn't say that.
Tom Lynch: I'm curious why you brought up dairy enzymes immediately. Is this issue...
Becky S: Well, because when I talked to you a few minutes ago you had mentioned that.
Tom Lynch: Oh, oh I see I talked to you originally.
Becky S: Otherwise I wouldn't have brought that up out of the blue.
Tom Lynch: Oh I see you are the one that sent me off the records.
Becky S: I'm just going through the second note, and says we asked the father to put in all fructose references. He had a complete normalization of his pattern.
Tom Lynch: So that could be toddler related
Becky S: Right, so the latest one did say he needed to be on a lactose limited diet, but nothing about taking enzymes though. Thats why I brought it up. If you were needing that from the doctor for school or something, he didn't mention that in his letter.
Tom Lynch: They did send a letter to the school and they did in fact... Well the state required something so they worked with the nurse to get something to the school.
Becky S: Ok, I guess they just didn't give us a copy then.
Tom Lynch: Do they have a contact number on there? I will have them send you one.
Becky S: Let me see here. No oh wait here.
Tom Lynch: And whats you fax number?
Becky S: <phone number>
Tom Lynch: Should I tell them to talk to Betty?
Becky S: No there are other nurses they can talk to.
Tom Lynch: Well I think the problem with the school is that they refuse to have a low lactose diet. They have a set cafeteria plan.
Becky S: And they don't make exceptions?
Tom Lynch: Well apparently they have a state law that says kids have to drink milk.
Becky S: Can I put you on hold real quick?
Tom Lynch: Well I guess we are finished. I was just going to say because they weren't going to do the lactose limited diet, they sent a letter saying something about him doing the dairy enzymes.
Becky S: Ok
Tom Lynch: But you know D*'s mother isn't...
Becky S: I'm sorry I have to put you on hold.
Tom Lynch: Ok?
Becky S: Ok sir. The doctor says he was pretty surprised that they didn't make exceptions.
Tom Lynch: Well I have taken the dairy enzymes to school and I have and seen him at lunch and noticed that he has been without.
Becky S: Ok
Tom Lynch: So I don't know if that was a mistake on a particular day.
Becky S: Right.
Tom Lynch: And what exacerbates this issue, is that his mom isn't telling people he is dairy intolerant.
Becky S: Oh ok
Tom Lynch: And I was just talking to the YMCA, and he had a snack and then had to run to the bathroom, but they didn't know. So thats why I was wondering if this went all the way back to the pediatrician. But you guys have record of it.
Becky S: Yes we do.
Tom Lynch: You know going out to the Mayo clinic, we went through a lot of expense. We tried to diagnose at first through observation, but his mom would just argue with me. She would say no he doesn't and poor Dr. Miroff just got caught in the middle there.
Becky S: Right
Tom Lynch: So finally I found the analytical test for it. So that put an end to the debate. But she continues to deny it. So it wouldn't hurt to mention it to her if you get a chance.
Becky S: Um actually, do you have joint custody?
Tom Lynch: Yes we have joint managing conservatorship
Becky S: Do we have a copy of the joint custody agreement?
Tom Lynch: I don't know. The last time I was at the pediatrician the folks were pretty rude to me and I wasn't really able tot talk to anyone.
Becky S: I'm sorry. In order for us to give out information like that in the future we do need a copy of that agreement.
Tom Lynch: Give out information about what? You mean to D*'s mom?
Becky S: Well to the both of you.
Tom Lynch: Well apparently you have been giving information to the both of us. Do you have a copy of it already? Well I guess you wouldn't since his mom hasn't been very forthcoming in the past.
Becky S: Well if she is presenting a problem then I suggest you bring us a copy to ensure we have it and that way everything will be good.
Tom Lynch: Ok, well I guess I can go head and fax that information over to you.
Becky S: That would be great.
Tom Lynch: Ok
Becky S: Thank you very much.
Tom Lynch: I would think you would have gotten that when D*'s records were transfered over from Dr. Miroff's office. I wonder what else you are missing. Ok well you have a good day.

H* Lynch: Tom, this is H*. Regarding your request to have D* this weekend, you need to give me the correct local address in Austin so that I can have that information. Cause I haven't received the letter yet. We are supposed to exchange D* in public. since school is not in session right now. So, if you are still interested having D* over the weekend, then it would be based on the California address. So I need a written e-mail regarding that once a month visit schedule, otherwise D* is staying with me this weekend. Thanks Bye.

Tom Lynch: Oh by the way about the mediator. You did not initial the divorce decree. This document which you insist upon following so closely.
H* Lynch: Yes?
Tom Lynch: On the binding part of the arbitration it does not have your signature, your, ok. So are you going to agree to binding arbitration, if we go into arbitration?
H* Lynch: (inaudible)
Tom Lynch: Well, I can tell you right now that you did not initial.
H* Lynch: I have to talk to my lawyer.
Tom Lynch: Well in that case we have not agreed...
H* Lynch: Now I may be wrong since this is a legal thing, but my understanding is (inaudible).
Tom Lynch: Thats not the case because you didn't initial it, Sorry.
H* Lynch: (inaudible)
Tom Lynch: H* you did not agree to binding arbitration.
H* Lynch: I don't know I have to look at it.
Tom Lynch: If you really want to go through arbitration and are not willing to agree that the arbitration is binding. I can do that in a very short time.
