--End of Tape
Tom Lynch: "Uh, hey this is your dad D*. Uh, talk to you soon,
Christian came by he is looking for you. Talk to later, bye. H* when is a
good time to get ahold of D*?"
[027]
Call to H*'s Cell phone
Tom Lynch: "H*, when is a good time to call? Umm,I would like to speak
with D*. You haven't answered your phone so, uh."
[011]
Called D* 2004 09 20 7:40PM
Tom Lynch: "H*, do you know that every time I call you, I'm calling for
D*, I record it? And, I have an hour of tape that says, "Leave a
message", and in this particular time we have, uh we have only one time when a
call has gone through. Uhm, I have to say these are not gonna look to good for
you if I want to make the case, you won't let me talk to my son, I think the
case is going to be pretty clear. And, don't you think it would be a good idea
to let me talk to him just for your sake? Uh I mean if your going to continue
this, where you try to take everything you might loose something
here. Anyways, uh I have called all different times, the only thing I can
conclude is uh, you see my caller id and you don't answer the phone. But if
there is a better time to call, um let me know."

Call Back
Tom Lynch: Hang-up

Call Back 8:10PM
Tom Lynch: Hang-up

Called D* 2004 09 22 6:42PM
Tom Lynch: " Hello, this is a call for D*. Uh this is your dad,
please call me or let me know if you got my call. I'll talk to ya'll soon. Uh
H*, if this is not a good time to call, about 7:00 in the evening, please
let me know, when is a good time to call. As I can't ever seem to get ahold of
my son on the phone. Um have a good day."
[028]
Call to H*'s Cell phone
Tom Lynch: "H*, I'm calling your cell phone number, for a number of
reasons. One, um I want to know when a good time to call D* would be. Uh
and the other reason is I sent you two mail messages yesterday and I just
wanted to make sure that you received them. If you didn't receive two mail
messages Monday evening, then I need to re-send those messages. You know if
you just not answering them, it wouldn't hurt to let me know that too. Also,
you've left open the medical insurance thing I still don't have updated
medical insurance information. I understand your on pre-scal now at
Motorola, a while back. And it is my understanding that the Motorola plan has
changed a while back and this is insurance information for D*. I need to
have that. So if the information I have is up to date, well I don't know how
you would know that for sure, uh let me know that so I can tell you what I've
got. Its a Motorola plan its called "Rewards, Health Advantage Plan, the Hap
plan", and according to this the group number is 55281002. So let me know. It
seems unlikely that this is up to date it has my name on it. I don't think,
wellhave you included me on your insurance, that would be awfully nice of
you. So, I'll talk to ya'll late, bye."

Calling Carol Dalton 2004 09 22 9:44AM
Tom Lynch: "Uh, Dr. Dalton, my name is Tom Lynch. I'm D*'s father and
I understand from H* that, recently here that she has started seeing you
again along with D*. I'd like to point out that according to our divorce
decree that she does not have exclusive medical rights, that in fact that all
decisions are to be joint. This includes decisions for treatment, and
counseling, although your name is mentioned in the divorce decree as a person
to consult, the decree doesn't give you 'carte blanch'. So I would like to
know what has been done, it is H*'s duty to report that and as you're the
doctor, I believe it is your duty as well to give me access to that
information. My telephone number is, or my fax number, since your sending
documents is 512-233-0770. Please give me a call if you have any questions. My
telephone number is area code 408-705-1093. Also, I would request that you
cease anything that your doing until we get this straightened out. I had one
other thing, I would like to know your relationship with Sarah Brandon, uh
H*'s attorney. Uh, psychologist that H*'s attorney requested to use
turned out to be a previous client of Sarah Brandon's. So I'd like to know if
you have any such conflicts of interest. I would like to know if you represent
her clients in court as well. As you might understand it would difficult to
gain a level of comfort required to do proper therapy if you were you charged
with building a case, so or, if it would seem to imply that you were charged
with. So please send me records I would like everything up to date, and
please stop what your doing until we confer about what we want to do in the
future. If you need documentation of the divorce decree, I would be glad to
send you copies. I'll warn you in advance that divorce decree was negotiated
during a sanctions hearing which wasn't going well for the other side, so
they wanted done quickly. And, in fact that former counselor was involved in
that, so there is hand writing on it. It was filed with the hand writing on it
and the hand-writing is significant, um I don't know of anybody saying it
isn't, so um anyways, any questions give me a call, have a great day, bye."
[014]
Called D* 2004 09 22 5:50PM
Tom Lynch: "Hello D*, I'm calling for you this is your dad, uh
H* if this isn't a good time to call, why don't you tell me when a good
time to call is. As always I can be reached at my numbers
512-775-9245. Anyways, D* I hope to speak with you soon. I love you."
[015]
Call to H*'s Cell phone
Tom Lynch: "H*, this is Tom I was trying to call for D* at the
house. well, as been the case for many days in a row, nobody answers the
telephone, I would like to speak with D*. Also, I called Carol Dalton
today to point out that you don't have exclusive medical rights, in fact we
have joint rights as you acknowledged in your e-mail, and so I would like you
to include me as always, have wanted, requested, and demanded actually that
you include me with medical decisions with D*, and that you cease acting
unilaterally. I requested that Carol Dalton stop seeing D* until we can
get that worked out, everything worked out. Also, as I have pointed out, I'm a
little worried about the fact that Carol Dalton was hand-picked by your
attorney. I just can't get out of my mind the previous hand-picked counselor
from your attorney was her former client. So I also would like to know what
Carol Dalton's relationship is with Miss Brandon, are they good friends, is
she a former client, etc... Anyways, please let me know when I call D*."
[016]
Call Back to H*'s Cell Phone
Tom Lynch: "Uh, H* I have asked a number of questions in an e-mail
which you have ignored, including information about D*'s health
insurance. Please update D*'s health insurance information with me. Uh
if the information was accurate and the mistake was at the office please let
me know that. So, I'll talk to you soon, thanks bye."
[029]
Call Back to H*'s Cell Phone
Tom Lynch: "Oh H*, also as I've I mentioned in the e-mail. Please
clarify whether you believe there is an arbitration clause in our divorce
decree. I see it there its pretty clear, it says arbitration is binding. I
believe in the past you have said that you don't think there is arbitration. I
would like to know where you stand on that. Because it appears that we are
going to have to do something pretty soon because you are excluding me from
the medical stuff, and your not returning my phone calls, you not even
answering my phone calls, your not replying to my e-mail, and its going to be
real hard to continue this joint managing conservatorship when I'm being cut
out. So I needing to prepare to see what we're going to do next. I would like
to know were your standing is with arbitration. I hope your not going to hold
this up simply as something to waste money. I don't want to pay for it if you
don't think its binding, it doesn't make sense to do that. If you are willing
to agree to our divorce decree, as it is then there is not a problem, so
please let me know. Have a good day."
